Formal Claim for Vehicle Damage Caused by Dangerous Road Defect

I am writing to formally submit a claim for damage to my vehicle caused by a dangerous pothole on a public highway for which you are responsible.

Location of Incident: Albany Road after the zebra crossing Date 27/03/2026

The defect was a large and deep pothole located near the edge of the carriageway. It had significant depth with sharp, broken edges and loose debris, indicating that it had been present for some time without adequate repair.

Due to its position within the driving lane and surrounding traffic conditions, it was not possible to safely avoid the pothole. Upon impact, the defect caused immediate and significant damage, resulting in a slashed tyre.

The severity of the pothole represents a clear danger to road users and suggests a failure to properly inspect and maintain the highway.

Under Section 41 of the Highways Act 1980, the highway authority has a duty to maintain the road. The condition of this pothole indicates that this duty has not been fulfilled.

I therefore request compensation for the damage caused. Please find attached supporting evidence: • Photographs of the pothole • Photographs of the damage to my vehicle/tyre • Invoice/receipt for repair or replacement

I look forward to your response within a reasonable timeframe. If I do not receive a satisfactory response, I will consider escalating this matter further.
